So my new iphone was stolen at the mall. Its my fault for not paying closer attention to it, it was a new iphone so that sucks. :(
What steps do I take now? Is there any chance of finding it or getting the iphone back from the theif?

Hi! Hopefully you had find my iphone turned on.
You can access it on your computer by going to http://www.icloud.com and signing on with your apple ID and password.
You can also use someone elses phone and go into their find my iphone app and put in your ID and password and it will show you a map and highlight where your iphone is currently located.
You should put your phone in "lost mode" first, and also put a permanent message on the screen saying "stolen or some message like that" so they can never sell it.
Also call your carrier and report it stolen, they will blacklist the iphone so it cannot be used.

Thanks can they actually use the iphone or once thats done they cant use it? Cant they just wipe it and clear it to factory mode?

No they cant, when they try to set it up it asks for the original owners ID and password, they cant use it. They also cannot remove that message off the screen that you put on there remotely, find my iphone is a great feature. They also cant turn off find my iphone as it needs your password to do so.
